Terms and Conditions of Sale – CapraiExperience.com

Acceptance of the Terms. By accessing and using the CapraiExperience.com website, you declare that you have read, understood, and unreservedly accepted the following Terms and Conditions of Sale.

Subject of the Service. The website offers services related to wine experiences at ARNALDO CAPRAI Società Agricola s.r.l. (hereinafter referred to as the “Arnaldo Caprai Winery”), including but not limited to guided tours and tastings, and the possible purchase of wine products, including wines and other alcoholic products.

Bookings and Payments (Wine Experiences)

Bookings and Payments. Bookings for wine experiences may be made online through the website. Payment must be made according to the methods specified during the booking process, using digital payment systems.

Exclusion of the Right of Withdrawal. Pursuant to Article 59, letter n) of the Italian Consumer Code, the right of withdrawal does not apply to the supply of services related to leisure activities where the contract provides for a specific date or period of performance. Therefore, once payment has been made, the Customer is not entitled to any refund, not even in the event of voluntary cancellation, impediment, or supervening impossibility, except in the case of cancellation by the Winery (as set out in the following paragraph).

Cancellation/Modification by the Winery. In the event of cancellation due to organizational reasons or force majeure (e.g., extreme weather conditions, health emergencies), the Winery will offer the Customer:

  • an alternative new date, or
  • a full refund of the amount paid.

The Winery is not responsible for any additional costs or damages incurred by the Customer (e.g., travel, accommodation, related bookings). The Winery reserves the right to modify the program of the booked experience for unforeseeable causes or causes beyond its control (e.g., adverse weather conditions, extraordinary maintenance, unavailability of staff or premises), while still guaranteeing a service of equal value or duration.

The Customer will be promptly informed by e-mail or telephone. In no case do such modifications give rise to a right to a refund, except in the case of total cancellation by the Winery.

Booking Confirmation. Confirmation of the booking will be sent by e-mail and will constitute the acceptance by the Arnaldo Caprai Winery to provide the agreed service.

Safety Terms for Guided Tours. In addition to these Terms and Conditions of Sale, the user accepts the following safety conditions for guided tours:

  • During the tour, areas used for production will be crossed, with the presence of vehicles, machinery, and people in movement.
  • Comfortable shoes and clothing are required.
  • The serving and sale of alcohol are prohibited to persons under 18 years of age.
  • Responsible consumption is encouraged.

Visitor’s Responsibilities. Every visitor is required to:

  • Follow the guide and their instructions throughout the tour.
  • Keep minors by the hand for the duration of the visit.
  • Pay attention to floors, steps, stairs, and railings.
  • Comply with emergency procedures, including escape routes and evacuation information.
  • Communicate any allergies and/or intolerances by writing to tour@arnaldocaprai.it, stating the order number, and at the time of check-in.

Gift Cards

Validity. Gift Cards are valid for 12 months from the date of purchase.

Use.

  • Virtual Gift Cards: may be used through the website to directly purchase experiences by entering the received coupon code at checkout.
  • Physical Gift Cards: may be used subject to telephone notice given 4 days before use.

Each Gift Card is subject to availability of the relevant period.

Sale of Alcoholic Products

Age Restrictions. The sale of wine and any alcoholic product is prohibited to persons under 18 years of age, in accordance with current Italian law (Art. 14-ter of Law 125/2001 and subsequent amendments).

By proceeding with the purchase on the website, the user declares and warrants that they are at least 18 years of age.

The Arnaldo Caprai Winery reserves the right to:

  • request age verification by self-declaration during the purchase process;
  • refuse or cancel an order should doubts arise regarding the purchaser’s status as an adult;
  • request an identity document upon delivery through the appointed courier (“Adult Signature” check).

Territorial Scope. The sale and shipment of alcoholic products is permitted exclusively within Italian territory. Orders destined for abroad cannot be fulfilled.

Prices, Payments, and Availability

The prices of wines and other alcoholic products are shown in euros, inclusive of VAT in accordance with current regulations.

Payment must be made using the digital systems available at the time of the order.

Product availability is indicated on the website but may vary rapidly depending on warehouse stock.

Shipping and Delivery

Shipments are carried out by specialized couriers and may involve:

  • delivery times that vary according to the address;
  • age verification of the recipient;
  • the requirement that an adult be present to receive the package.

The Arnaldo Caprai Winery is not responsible for delays attributable to the courier.

It is the purchaser’s responsibility to check for any damage upon collection of the order. Any damage must be reported immediately to the courier at the time of collection and, in any event, within 24 hours of delivery, attaching photographic documentation.

Right of Withdrawal (Sale of Wine and Alcoholic Products)

The customer has the right to withdraw within 14 days of purchase, as provided for by the Consumer Code, with the exception of bottles that have been opened or damaged after delivery.

The right of withdrawal does not apply to:

  • opened products;
  • products damaged by the customer;
  • perishable products or products sensitive to improper storage.

Amendments to the Terms

Changes to Services and Updates. The Arnaldo Caprai Winery reserves the right to make changes to the services offered, including any changes to the Terms and Conditions of Sale. Users will be informed in the event of updates.

Data Processing

  • Data is processed by ARNALDO CAPRAI Società Agricola s.r.l. and its closest collaborators, ensuring confidentiality.
  • By purchasing on our website, the user accepts that their data may be used by ARNALDO CAPRAI Società Agricola s.r.l. to contact the user through automated and non-automated means in the following cases:
    • updates on purchases;
    • updates on order status;
    • updates on events or experiences;
    • marketing and/or remarketing activities on third-party newsletter or online advertising platforms.
  • No use other than that described above will be made.
  • Users may request the complete deletion of their data by writing to tour@arnaldocaprai.it.

Governing Law

These Terms and Conditions of Sale and Data Processing are governed by Italian law. In the event of disputes, the court of Perugia shall have jurisdiction.

By using CapraiExperience.com, the user confirms that they have read, understood, and fully accepted these Terms and Conditions.
